Are septic rules different over the Edwards Aquifer in Texas?
TexasReviewed October 2026
Yes. On the Edwards Aquifer recharge zone in parts of Central Texas, 30 TAC §285.40 adds stricter rules. Lots generally need at least 1 acre per single-family dwelling, with some older platted lots in certain counties exempted. All planning materials must be prepared by a professional engineer or professional sanitarian. Tanks need at least 50 feet from mapped recharge features, and soil absorption systems need 150 feet. Sellers must also tell buyers whether a water pollution abatement plan has been submitted or approved. The rule names counties such as Bexar, Comal, Uvalde and Kinney; ask your permitting authority whether the recharge zone covers your land.
Check your local rule. This varies by state, county or city. Your permitting office has the final word; the official lookup pages below show you who that is.
