Do I need a septic permit on 10 acres or more in Texas?

TexasReviewed October 2026

Possibly not, but confirm locally. TCEQ says a permit and approved plan are normally required to build, alter, repair or operate an on-site sewage facility. One exemption, often called the "10-acre rule," can apply to a single-family dwelling on a tract of 10 acres or more if specific criteria are met, including a professional site evaluation and keeping the system at least 100 feet from property lines. Local permitting authorities, which may be a county, city, river authority or health district, can have additional requirements. TCEQ advises confirming any exemption with the local permitting authority, which you can look up by county on TCEQ's website.

Check your local rule. This varies by state, county or city. Your permitting office has the final word; the official lookup pages below show you who that is.
